Viet Web LLC provides software-as-a-service (SaaS) solutions, including mobile applications for iOS and Android platforms. Our Services may include, but are not limited to:

  • Mobile applications available on the Apple App Store and Google Play Store
  • Web-based services and platforms
  • Customer support and related services

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without notice.

3. User Accounts

3.1 Account Creation

Some features of our Services may require you to create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized use of your account

3.2 Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

4. User Conduct

When using our Services, you agree not to:

  • Violate any applicable laws, regulations, or third-party rights

The Services and all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio, video, software, and code) are owned by Viet Web LLC or our licensors and are protected by copyright, trademark, patent, and other intellectual property laws.

5.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use. This license does not include the right to:

  • Modify or copy the Services
  • Use the Services for any commercial purpose
  • Transfer or sublicense the Services to any third party
  • Remove any copyright or proprietary notices

5.3 User Content

You retain ownership of any content you create or upload through the Services ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with providing the Services.

6. Payment Terms

If you purchase any paid features or subscriptions:

  • You agree to pay all applicable fees as described at the time of purchase
  • Payments are processed through the applicable app store (Apple App Store or Google Play) and are subject to their terms
  • Subscriptions will automatically renew unless cancelled before the renewal date
  • Refunds are handled according to the policies of the applicable app store

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • The Services will be uninterrupted, secure, or error-free
  • The results obtained from using the Services will be accurate or reliable
  • Any errors in the Services will be corrected

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIET WEB LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless Viet Web LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your User Content

10. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

  • Your right to use the Services will immediately cease
  • We may delete your account and any associated data
  • Provisions that should survive termination will remain in effect

You may terminate your account at any time by contacting us or using the account deletion features in our applications.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Services after any changes constitutes your acceptance of the new Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Cheyenne, Wyoming, and the arbitrator's decision shall be final and binding.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Viet Web LLC regarding the Services and supersede all prior agreements and understandings.

15. Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.
